Terms and Conditions of use of the tamoil.com (“Tamoil”) web site
These terms and conditions were last amended on 22 October 2004

IMPORTANT – PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY

• All visitors to the Tamoil web site are bound by the following terms and conditions and they should therefore ensure that they read them carefully.

• If you use the Tamoil web site or any of the services available there, that means that you have accepted that these general terms and conditions apply to you. Otherwise you may not use the Tamoil web site or any of the services available there.

• We may revise these terms and conditions at any time without notice. From time to time you should revisit these general terms and conditions so that you can be sure that you are aware of the most recent version. We will always clearly mark the date these terms and conditions were last changed.

• Companies have their own separate identities, but in the Tamoil web site and in these terms and conditions, for the sake of simplicity and convenience the terms “Tamoil”, “Oilinvest”, “Group”, “we”, “our” or “us” are used to refer to companies within the Oilinvest organisations. There are two of these at present, one headed by Oilinvest (Netherlands) B.V. and the other by Oilinvest International N.V.

• We refer below to each visitor to the Tamoil web site as a “visitor”, or to “you” (and “your” is also used accordingly).

• For the purposes of these terms and conditions the Tamoil web site includes the tamoil.com top site, together with links to any other Tamoil web sites. Use of the Tamoil web site is at each visitor’s own risk and on his or her own responsibility.

• If you use the Tamoil web site, or any of the services available there, after any change to these terms and conditions that will amount to your acceptance that those changes apply to you.

• The services presently accessible through the Tamoil web site are:
- Market Quotations; 
- Route Planner;
- Trip Itineraries;
- Weather Forecast; and
- the Energy Glossary.

We refer to these throughout these terms and conditions as the “Services”.

• We may at any time, and without notice, suspend, or completely cancel, the provision of part or all of any of the Services.

• At present you do not need to pay to use any of the Services.

• We give no guarantee of the validity or accuracy of any of the Services.

• If for any reason you are unable to use any of the Services at any time, we will not be liable to you as a result. Equally, we have no liability to you as a result of your use of any of the Services. We cannot be held responsible by you for damages, compensation for losses (direct or indirect), or for any other reason from your use of any of the Services.

• We will not be liable to you:

- for any inaccuracies or omissions in Tamoil’s web site; or
- for any decisions based on information contained in Tamoil’s web site which you may make. Knowing this, you accept full responsibility for the consequences (direct and indirect) of your own acts and decisions; or
- in any event, for any direct, special, indirect, or consequential damages, or any other damages of any kind, resulting in any way from your use of any information obtained directly or indirectly from the Tamoil web site.

• We have made all reasonable efforts to ensure that all information provided by Tamoil on the Tamoil web site was accurate when it was posted there, but we do not guarantee its accuracy (or that of any information you may obtain through any hypertext links from Tamoil’s web site to third parties), or that it has been kept fully up to date, although we do try not to let information become inaccurate through the passage of time. If there are any occasional errors these are inadvertent, for which we apologise. We reserve the right to make changes and corrections to the Tamoil web site at any time without notice.

• Oilinvest is not responsible for the content of any other web site, including any through which you may have gained access to the Tamoil web site, or to which you gain access from the Tamoil web site.

• If you decide to access a third party’s web site through a link provided in the Tamoil web site, you do so at your sole risk. We do not accept any liability in connection with any such sites or links. Where we provide a hyperlink to a third party’s web site this does not signify that Tamoil approves the contents of the third party web site. In certain circumstances you may connect to a web site containing views contradictory to those expressed on the Tamoil web site.

• The Tamoil trademark is owned by Oilinvest (Netherlands) B.V. and its use is licensed to various companies within both the Oilinvest organisations (see above).

• Nothing you may see on the Tamoil web site, or any information you may obtain from using the Tamoil web site (including through any hypertext links) is intended to be, or constitutes, an invitation to invest, or otherwise deal in, shares or other capital of Oilinvest.

• If you see any statements on the Tamoil web site or in any document which you access from the Tamoil web site which includes words such as “anticipates”, “believes”, “plans”, “projects” etc., these are, or may be, forward looking statements. Any forward looking statement is subject to risk and uncertainty. Actual results may vary from those expressed in such a statement. We do not undertake to update any forward looking statement to reflect any changes in our expectations, or to reflect what actually happens, although (as stated above) we do try to make sure that what is stated on the Tamoil web site is not made redundant or obsolete by the passage of time.

• If you provide us with any information, you agree that we have unlimited rights to that information as provided, and that we may use that information in any way we choose. No information provided by you will be, or will be treated by us as being, in any way confidential, unless otherwise stipulated by us on the Tamoil web site.

• The Tamoil web site contains material including text, photographs and other images which are protected by copyright, and possibly by other intellectual property rights. All copyright and other intellectual property rights in this material are either owned by Oilinvest, or have been licensed to Oilinvest by the owner of those rights so that it can use this material as part of the Tamoil web site.

• Except for temporary copies of materials on the Tamoil web site which your internet browser may need to create to allow you to access the Tamoil web site (which you agree to delete from your computer as soon as you leave the Tamoil web site, without keeping any copy of any such materials in any form whatever), you may not, without our prior written consent, copy (in any way), alter, tamper with in any way, or use any material (either in whole or in part) contained on, or accessed through the Tamoil web site (but this restriction does not extend to any material you may access as a result of using a hyperlink which takes you outside the Tamoil web site, since that material does not belong in any way to Tamoil).

• You agree not to violate the security of the Tamoil web site or Services or to make any attempt to do so.

• You may not link to the Tamoil web site without our prior written consent.

• These terms and conditions are governed by, and are to be interpreted in accordance with, English law. If there is any dispute arising in relation to these terms and conditions, or any dispute arising in relation to the Tamoil web site, the English courts are to have non-exclusive jurisdiction over the dispute.

• If any part of these terms and conditions is held by any court or other competent authority to be invalid, unlawful or unenforceable to any extent, it will be severed from the remaining terms and conditions to the minimum extent necessary to ensure that the remainder of these terms and conditions remain valid, lawful and enforceable to the fullest extent permitted by law.
