General

• For the purpose of these terms and conditions references to the Tamoil website refers to the tamoil.com website.

• Tamoil Group companies have their own separate legal entities. Other Tamoil Group company websites may contain terms and conditions which are different from these terms and conditions. Please check the terms and conditions of each website which you visit and do not assume that these terms and conditions apply to all Tamoil Group company websites.

• References in these terms and conditions to “we”, “our” or “us” are used to refer to Oilinvest (Holdings) N.V. and Oilinvest (Netherlands) B.V. only.

• Unless specified otherwise, references in the Tamoil website to “Tamoil”, “Oilinvest”, “Group”, “Tamoil Group”, “we”, “our” or “us” are used to refer to Oilinvest (Holdings) N.V. and its subsidiaries and affiliates.

• Each visitor to the Tamoil website is referred to as a “visitor” or to “you” (and “your” is used accordingly).

• All visitors to the Tamoil website are bound by the following terms and conditions and should ensure that they have read them carefully. By using the Tamoil website or any of the services available on it, you have accepted that these terms and conditions apply to you. If you do not agree with these terms and conditions and do not want them to apply to you, please do not use the Tamoil website or any of the services available on it.

• We may revise these terms and conditions at any time without notice. From time to time you should revisit these terms and conditions to ensure that you are aware of the most recent version. If you use the Tamoil website, or any of the services available on it, you will be deemed to have accepted and agreed to these terms and conditions and any subsequent changes to them and, accordingly, the said changes shall apply to you.


Services

• The services presently accessible through the Tamoil website are:

- Route Planner;
- Trip Itineraries;
- Weather Forecast; and
- the Energy Glossary.

We refer to these services throughout these terms and conditions as the “Services”.

• We may at any time, and without notice, suspend or completely cancel the provision of all or part of any of the Services.

• We give no guarantee in respect of the validity or accuracy of any information provided by the Services or resulting from their use.

• If for any reason you are unable to use any of the Services at any time, we will not be liable to you in respect of the unavailability of any of the Services. Equally, we have no liability to you as a result of your use of any of the Services. We cannot be held responsible by you (or any other third party, whether on your behalf or otherwise) for damages, compensation for loss (whether direct or indirect) or any other liability as a result of your use, or unavailability, of the Services.


Disclaimer

• Use of the Tamoil website is at each visitor’s own risk and is his or her own responsibility. We will not be liable to you for, inter alia, any inaccuracies or omissions on the Tamoil website, or for any decisions you make based on information contained on the Tamoil website.

• You accept full responsibility for the consequences (direct and/or indirect) of your own acts and decisions or any direct, special, indirect or consequential damages (or any other damages of any kind) resulting in any way from your use of any information obtained directly or indirectly from the Tamoil website.

Information

• If you provide us with any information (other than personal information), you agree that we have, together with any other Tamoil Group company, unlimited rights in respect of the information provided and that we may use that information in any way we choose. No information provided by you will be treated by us as being in any way confidential (other than personal information), unless otherwise stipulated by us on the Tamoil website.

• Any personal information that may be collected on the Tamoil website is intended exclusively for use by the Tamoil Group’s marketing departments so that you can benefit from the services offered by the Tamoil Group. None of your personal information will be communicated to third parties or used for unauthorised purposes.


Intellectual Property

• All corporate names, logos, registered and trademark products mentioned on the Tamoil website belong to Oilinvest (Netherlands) B.V. and their use is licensed to various companies within the Tamoil Group. They may not be used without the prior written agreement of Oilinvest (Netherlands) B.V.

• The Tamoil website contains material (including text, photographs and other images) which is protected by copyright and possibly by other intellectual property rights. All copyright and other intellectual property rights in these materials are either owned by a Tamoil Group company or have been licensed to a Tamoil Group company by the owner of those rights.

• Copies of documents contained on the Tamoil website can only be made for information purposes, and strictly for private use. No license and no rights other than the right of site viewing are granted to any person in respect of intellectual property rights. You may not in any way, without our prior written consent, alter, tamper with or use any material (either in whole or in part) contained on, or accessed through, the Tamoil website.

• You agree not to breach the security settings of the Tamoil website or of the Services or to make any attempt to do so.

• You may not create a link to the Tamoil website without our prior written consent.


Jurisdiction

• These terms and conditions are governed by, and are to be interpreted in accordance with, the laws of England and Wales. If there is any dispute or claim (whether in contract, tort or otherwise) arising in relation to these terms and conditions, or any dispute or claim (whether in contract or tort or otherwise) arising in relation to the Tamoil website, the courts of England and Wales shall have non-exclusive jurisdiction over such dispute or claim.


Severability

• If any part of these terms and conditions is held by any court or other competent authority to be invalid, unlawful or unenforceable to any extent, it will be severed from the remaining terms and conditions to the minimum extent necessary to ensure that the remainder of these terms and conditions remain valid, lawful and enforceable to the fullest extent permitted by law.
